7/30/20 Congratulations Saray N. Ravelo for arguing and securing an order granting summary judgment on Plaintiff’s Actual Agency vicarious liability claim against our hospital client.  These rulings are difficult to obtain in the State of Florida as plaintiffs’ lawyers successfully argue hospital rules and regulations, bylaws and policies and procedures evidence control over the privileged physician.  Not this time!  This is a fantastic win for the medical malpractice team and our client!


Another Win For The Med Malpractice Team!

6/5/20 –  Paula Lozano and Michael DiRaimo obtained a dismissal with prejudice for our hospital client in a medical malpractice lawsuit.  The claimant failed to properly engage in statutory presuit.  When notified of this fact, the statute of limitations had already passed.  Claimant attempted to engage in presuit again, and was notified by defense counsel the statute of limitations had run, and the hospital would seek a Motion to Dismiss and Sanctions if counsel pursued the case.  Plaintiff filed the lawsuit, and the hospital filed a Motion to Dismiss and Motion for Sanctions.  In response, the opposing side filed questionable affidavits that the Court clearly did not accept as true.  The Hillsborough County Court granted the Motion to Dismiss with Prejudice and reserved jurisdiction to hear argument on sanctions and fees.  Congratulations to Mr. DiRaimo taking the lead on the motion and oral argument!  Despite the crazy and unprecedented times, this is the third dispositive win for our various hospital clients in 2020!

Congratulations to Paula J. Lozano and Saray N. Ravelo for another trial defense verdict!

This most recent win involved a medical malpractice claim alleging the defendant critical care surgeon failed to timely intubate or perform a surgical airway on a patient in the ICU resulting in hypoxic brain injury and death.

Our trial team argued the physician followed the standard of care and autopsy evidence completely negated hypoxic brain injury. The Polk County jury returned a complete defense verdict after just 48 minutes of deliberation. We are thrilled for our client and our medical malpractice team being two for two in 2020’s trial line up!


Congratulations to Paula Lozano and Saray Ravelo for a complete defense verdict in a medical malpractice trial in Polk County, Florida. The case involved allegations of a rotator cuff injury as a result of alleged negligent physical therapy at the hospital. The jury returned a complete defense verdict in approximately 45 minutes. This was a fantastic way to start out the year at Walters Levine Lozano & DeGrave!


COMPLETE DEFENSE VERDICT – LONG TERM CARE CASE

Walters Levine Lozano & DeGrave is proud to announce a fantastic win for one of our long term care clients. Saray N. Ravelo received a complete defense arbitration verdict in a case that involved a senior living resident who had fallen and failed to wear his Life Alert pendant. After having been down for more than 15 hours, the resident developed rhabdomyolysis, a decline in overall health and died a couple months later. The plaintiff alleged the community had a duty to respond and/or check on the resident when he did not show up at meal time and a therapist reported hearing him calling someone’s name from his apartment. Saray aggressively defended all elements of the case and received a complete defense verdict. Congratulations, Saray!


Jamie A. Cummings was selected as South Tampa Chamber of Commerce Ambassador of the quarter.


Walters Levine Lozano and DeGrave attorney Paul Fischel (seen in this image) was proud to volunteer with the Greater Tampa Chamber of Commerce’s Community Outreach Taskforce and Meals on Wheels. Paul delivered thirteen (13) hot lunches and good cheer to members of our community in need. “They’re really wonderful people. They each got a freshly cooked lunch, but I got more in return.”


Walters Levine Lozano and DeGrave attorneys Jamie Cummings and Caitlin Poor (seen in this image) were proud to volunteer and support the South Tampa Chamber of Commerce at their 22nd Annual Fall Golf Classic. All proceeds raised went to Troop Rewards, a charity benefiting service members and their families.  Not pictured are Managing Shareholder Stuart Levine and  attorney Paul Fischel who supported the Golf Classic by golfing in the tournament.

Paula J. Lozano presented at the Manatee County Medical Society on Saturday, January 13, 2018 to community physicians who required two hours of Continued Medical Education credits on the topic of Preventing Medical Errors.  The two hour presentation focused on the most common causes of medical errors, the benefit of a root cause analysis, the five most misdiagnosed medical conditions in Florida over the last two years, as well as strategies to prevent future medical errors.  The presentation was informative, interactive and a huge success!  Ms. Lozano remains available to present on a variety of medical-legal topics for physicians, physician groups, insurance companies, and hospitals.

Saray Noda, who recently joined Walters Levine Lozano and DeGrave, was featured in the Florida Bar News for a project developed during her presidency of the 10th Circuit Young Lawyers Section. The “Crafting Justice” Poster contest asked middle and high school students in Polk County to create posters showing “What is Justice?” Ms. Noda presented the project for grant funding during the Florida Bar YLD’s Affiliate Outreach Conference. Several members of the 10th Circuit Judiciary selected the poster finalists, who were celebrated at a reception in April. (Read More)
